General Terms and Conditions of the Online Store
These Terms of Use, together with the Privacy Policy, the RETURN POLICY and the terms SHIPPING and PAYMENTS apply to every sale of products (hereinafter referred to as "Products") made by the company under the name "EVERSTIS OPTIMUM" and the distinctive title "FOX4HEALTH", which is based in Pythagora 81, Korydallos 181 20, G.E.M.I. The following General Terms and Conditions of the contract (hereinafter referred to as Terms of Use) have been formulated with the aim of pursuing and setting out in a clear, transparent and comprehensive manner, in accordance with the relevant principles and provisions regarding the validity of contracts, the terms and conditions governing the relationship between the Company and any visitor and/or customer of the Store, in accordance with Law 2251/1994 on "Consumer Protection" and Law 2472/1997 "Protection of individuals with regard to the processing of personal data", and Regulation (EU) 2016/679, as currently in force.
The following terms and conditions exclusively cover all sales of products through the COMPANY's online store located at www.fox4health.gr. Any other terms and conditions are expressly excluded. Any User who enters and transacts or uses the services of the online store (hereinafter referred to as the "Customer" or "User" respectively) is deemed to consent to and unreservedly accept the terms set forth herein, without exception. If a User does not agree with these terms, they must refrain from using the online store and from any transaction with it. The COMPANY reserves the right to change the terms of use at any time.
Product orders are submitted by completing and submitting the special Order Form available in the online store. By completing and submitting the order, the Customer expressly and unreservedly declares that, prior to submitting their order and committing to a distance contract, they have been clearly and comprehensively informed of the following information:
- the main characteristics of the goods and products sold by our online store.
- the identity, address, telephone number, and email address of our COMPANY.
- The total price of the products in the order, including VAT, any other fees, and all additional shipping, delivery, or postage charges, as well as any other expenses. The prices of the products listed in the online store are final (including the applicable VAT). The above final prices of each product in the online store do not include shipping costs, which are calculated after the order is placed based on the shipping method selected.
- The cost of using the means of distance communication for the conclusion of the contract, when calculated on the basis of a charge other than the basic tariffs.
- The means of payment, delivery, execution, as well as the deadline within which the COMPANY undertakes to deliver the goods, as well as any delivery restrictions and means of payment.
- The conditions, exceptions, deadline, and procedures for exercising the right of withdrawal, as well as the obligation to charge the Customer with the direct cost of returning the products to the COMPANY in the event of withdrawal, as well as the withdrawal form template.
- The existence of the COMPANY's liability for actual defects and lack of agreed characteristics in accordance with Articles 534 et seq. of the Civil Code.
- The possibility of resorting to an out-of-court complaint and redress mechanism to which the COMPANY is subject, as well as the ways of accessing it.
- The obligation to pay upon placing the order.
Products for sale - Prices
The products sold by the Store are products of the Company (hereinafter referred to as the "Products"). Their characteristics and other accompanying information are available and can be found in the Store next to the corresponding product. The prices listed in the relevant catalogs next to each product include VAT (24%), but do not include shipping costs (which are mentioned in the special section "SHIPPING METHODS"). These prices apply to the Products and quantities available in the Company's warehouse, and the Store reserves the right to adjust prices without notice.
Payment Methods
The fox4health.gr online store offers three payment methods for your order (payment methods cannot be combined for the same order): Cash on delivery, credit or debit card, PayPal, and deposit to the company's bank account. The Store has taken all necessary measures to ensure the security of transactions using your credit card. However, in the event of proven fraudulent use of your credit card, your charge may be canceled upon your request to the bank that issued your credit card, which is required to investigate your complaint or report. For this reason, you are obliged to inform the issuing Bank as soon as you become aware of such an incident, so that your card can be cancelled and its use by unauthorised persons can be prevented.
At FOX4HEALTH, the security of online purchases is fundamental. All transactions are carried out through secure payment systems and confidential payment details are transmitted directly and encrypted (SSL) to the bank.
Payments for orders made by credit/debit card are securely processed using SSL Security & Technology Certification, which is verified through the VISA and MASTERCARD 3D Secure Network system. In addition, secure payment via PayPal or cash on delivery is also possible, with an additional charge per order.

Shipping Products
The Products are of excellent quality, meeting international quality standards, and are carefully packaged for delivery.
Orders are packaged and shipped Monday through Friday. Most orders are shipped within 24 hours of being placed. Orders placed on weekends and during holidays are picked the next business day.
Deliveries are made daily from 9:00 a.m. to 5:00 p.m., except Saturdays, Sundays, and holidays.
The Products will be sent to you via courier service in accordance with the specific terms set out in the special section of our website. “SHIPPING PRODUCTS” and no later than 3 days from the date of confirmation of your order.
The shipping time of the Products is subject to the availability of the ordered products in the Store's warehouses as well as to reasons of force majeure (e.g. bad weather conditions, strikes, etc.), in which case we will notify you by email or telephone so that you can inform us whether you wish to complete your order under these circumstances.
In the event of customs duties, the consumer shall be charged. The consumer may be required to pay an amount relating to customs duties and/or customs charges. All taxes and customs charges are the responsibility of the customer and are not included in the cost of the order or shipping costs. Taxes and customs charges vary depending on the country and state of the shipping address. We recommend that you contact your local customs office if you are unsure about the applicable taxes and customs charges that apply to you. FOX4HEALTH is not responsible for any additional taxes and customs charges that may be required when shipping your order.

Right of Cancellation or Withdrawal
You have the right to cancel, change, or return your order within 14 days. The cancellation period will expire 14 days from the day following the day on which you (or someone you have designated, other than a carrier) received the last of the goods. We will refund you without undue delay and no later than:
- 14 days after the day we receive any of the delivered goods from you. or
- (if earlier) 14 days after the day you provide us with evidence that the goods have been returned. or
- if no goods were delivered, 14 days after the day on which we were informed of your cancellation.
We will refund you using the same means of payment you used for your initial transaction, unless you have expressly agreed otherwise and this is feasible for us. In any case, you will not incur any additional charges as a result of the refund.
If we have shipped products to you and you have canceled your order, we may withhold your refund until we receive the products back or you have provided proof of shipment, whichever is earlier. If we do not receive the products back, we may arrange to collect them from you at your expense.
You must return the canceled orders to the above address without undue delay and in any case no later than 14 days from the day on which you notify us of the cancellation of our contract. The deadline is met if you send the goods before the 14-day period expires.
You are solely responsible for any diminished value of the goods resulting from the handling other than what is necessary to determine the nature, characteristics, and functioning of the goods.
Please note that you can only exercise your right to cancel your order under the law if you give us formal written notice of cancellation at any time after placing your order, up to 14 calendar days from the day you receive your order, by email or as described above.

Our Online Store allows you to choose to be informed about our new products, offers, and services by sending occasional promotional messages with information to the email address or phone number you have previously provided. The Store will under no circumstances misuse the above service.

Responsibility of the parties
By accepting these Terms and Conditions and browsing the Store, you represent and warrant that you have the legal right to enter into this agreement and to use the Store in accordance with the terms and conditions set forth herein. Furthermore, as a visitor/user of the Store, you agree and accept that you are financially responsible for any use of the Store as well as for the use of the fox4health account by others – including people who coexist with you – and therefore, you agree to supervise any use of the Store by persons under the age of 18 using your account or the skin4sin name.
The Company, including its consultants and employees, is liable for actual defects and the lack of agreed characteristics of the Products in accordance with Articles 534 et seq. of the Civil Code, only for fraud or gross negligence and only for positive damage, and its liability cannot exceed the value of the Products sold.
Applicable law and other terms
The Company and the Store reserve the right to modify or update the Terms of Use in writing without prior notice, effective from the date posted on the Store's website. Failure by the Company to exercise any of its rights shall not be construed as a waiver.
These general terms and conditions are governed by Greek law. Any dispute arising from the contractual relationship between “fox4health” and the customer shall be settled by the competent courts of Athens. For out-of-court settlement of the dispute, you can contact the competent bodies for out-of-court settlement of consumer disputes, e.g. the General Secretariat for Consumers of the Ministry of Development and Investment (Pl. Kaningos, 10181, Athens, Consumer Protection tel.: 1520, fax: 2103843549), the Consumer Ombudsman (www.synigoroskatanaloti.gr, 144 Alexandras Avenue, 114 71, Athens, tel.: 2106460734, fax: 2106460414), to the Committees for the Amicable Settlement of Consumer Disputes (Article 11 of Law 2251/1994).

The protection afforded by the provisions of the law on distance contracts, as well as these terms and conditions, is emphasized, that it applies only to transactions with natural persons who transact for reasons that do not fall within the scope of their commercial, craft, business, or professional activity.
In the event that any provision of this agreement is not enforced, the remaining provisions shall remain in full force and effect.
Any provision of the above terms that is deemed to be contrary to the law shall automatically cease to apply and shall be removed from this document, without affecting the validity of the remaining terms.
This Agreement constitutes the entire understanding and agreement between the COMPANY and the Customer. The COMPANY may amend the terms and conditions of this Agreement, and/or its policies and/or procedures at any time by announcing the changes in the Online Store.
The Company and the Online Store reserve the right to modify or update these Terms of Use in writing without notice, which shall be effective from the date of their posting on our Online Store website.
